Brand Goods

Goods bearing registered trademarks or brand marks; customs may require brand authorization, and unauthorized shipments risk IPR seizure.


Brand Goods are items whose packaging or product carries a registered trademark, brand logo, or IPR-protected marking. In cross-border transport and clearance, customs (especially in the US, EU, Japan and other countries operating IPR customs recordation) may require the importer or shipper to provide a brand authorization or distribution license, in order to distinguish genuine parallel imports and authorized goods from counterfeits. Brand goods that cannot prove authorization risk being detained or destroyed by customs on IPR-infringement grounds.

Do I need an authorization letter to export genuine brand goods?
It depends on the destination and channel. If the brand is recorded with destination customs for IPR protection, customs may ask for a brand authorization or purchase documents proving legitimate sourcing on inspection. Prepare the authorization chain in advance and confirm the channel's brand-goods policy with your forwarder.
Do OEM private-label products count as brand goods?
If the finished product carries a registered trademark, it is treated as brand goods. For OEM exports you must hold written authorization from the trademark owner to use the mark; otherwise, even normally manufactured goods may be deemed infringing and seized at destination.
